Esteban Nunez’s Prison Sentence Shortened From 16 Years To 7 Years

SAN DIEGO -- The son of former Assembly Speaker Fabian Nunez of Los Angeles had his prison sentence for a San Diego killing shortened Sunday by Gov. Arnold Schwarzenegger on the last day of his administration.

Esteban Nunez, 22, of Sacramento, pleaded guilty to voluntary manslaughter and two counts of assault with a deadly weapon for a drunken knife fight near San Diego State University in 2008 in which college student Luis Dos Santos was killed. He was sentenced to 16 years in prison.

Schwarzenegger commuted his sentence to seven years.

On Monday, San Diego County District Attorney Bonnie Dumanis issued the following statement regarding Schwarzenegger's decision: "We were shocked to hear of the Governor's last-minute commutation, which greatly diminishes justice for victim Luis Santos and re-victimizes his family and friends. The District Attorney's Office was not consulted and the decision comes as the appeals process was continuing."

Additionally, San Diego City Attorney Jan Goldsmith reacted to the decision through the following statement: "Esteban Nunez -- son of former Assembly Speaker Fabian Nunez -- is a criminal who was sentenced by an experienced and well-respected Superior Court Judge. Governor Arnold Schwarzenegger reduced the sentence by over half to help his political crony's son. In doing so, he undermined the judicial system and has jeopardized public safety ... This homicide occurred in the City of San Diego. I speak for the overwhelming majority of San Diegans in stating that we are appalled and angry over Mr. Schwarzenegger's conduct. It reflects poorly on him, personally, and on his legacy as governor."

Ryan Jett, 25, of Sacramento, also pleaded guilty to voluntary manslaughter and assault for instigating the incident, in which two of Santos' friends were also stabbed and another friend suffered an eye injury.

Two others -- Leshanor Thomas, 21, and 20-year-old Rafael Garcia -- pleaded guilty to lesser charges.

On Oct. 4, 2008, Nunez and Jett fought with Santos and several others near San Diego State University. During the fight, Jett stabbed Santos to death.

Both Jett and Nunez pleaded guilty and were sentenced to the maximum prison term. Nunez asked that his sentence be shortened because he received the same penalty as Jett, although he did not kill anyone.

"Santos's death is tragic, and I do not discount the gravity of the offense," Schwarzenegger said in his commutation message. "But given Nunez's limited role in Santos's death, and considering that, unlike Jett, Nunez had no criminal record prior to this offense, I believe Nunez's sentence is excessive. Accordingly, I commute Nunez's sentence to the lower term for the crimes for which he was convicted: seven years in state prison."

The Governor's Office did not say when Nunez might be eligible for parole.

Fabian Nunez, a Democrat, served as Assembly speaker from 2004 to 2008.

He is also a business partner of the governor's top political adviser at the consulting firm Mercury Public Affairs, the Los Angeles Times reported.

"We are totally outraged," Fred Santos, the father of Luis Santos, told The Times.

"For the governor to wait until the last day in hopes it would fly under the radar is an absolute injustice," he said.

He said Esteban Nunez "had already gotten lucky once" when prosecutors agreed to a plea bargain so he could avoid being tried for murder, which could have resulted in a life sentence.

He said his family got no advance warning about the commutation and only learned about it from reporters.

"The governor did not even have the courtesy to notify the victim's family," he told The Times. "This is dirty politics: cutting backroom deals. I guess if you're the son of somebody important you can kill someone and get all sorts of breaks."

A spokesman for Schwarzenegger said the Governor's Office had no comment beyond the statement it sent.

well at least this is how the story goes. however I have been asking everybody I know if they can show me where it says that jesus was born today. so far nobody has been able to show me. Of course they say its in the bible so I ask them where in the bible and I usually get one of those looks like "is this guy trying to make me look stupid?" kinda looks. The answer is no Im not trying to make anybody look stupid I just want to know why in the fuck everybody believes this!!! Ive read the bible and no where in it does it say that december 25th was the day. Now I know why everybody believes it. Thats because the PRIEST told them. Or at least hinted to in some sermon. The truth is the priests dont have to be specific about it because of all the other social constructs in our every day do the rest. All the lights and decorations and everybody saying merry christmas reinstates the belief in peoples mind.

This is cause for concern. We have come to be so psychologically malleable that hard evidence is no longer necessary for us to accept something as being true. All that we need is the right people, in the right positions, to say the right things and we will swallow it all hook line and sinker. We dont ever have to actually read the passage from the bible that says that this is the day Jesus was born and we will still go along with it. So say Im wrong and it does say it in the bible. The fact that people dont know where it is in the bible and still go along with it is evidence that FAITH is at hand. After reading THE VIRTUE OF SELFISHNESS i started to really think about the ill effects that this type of behavior can have on the quality of ones life. When one circumvents the mind by accepting things on faith essentially one is telling their mind to GET LOST and that ones mind IS REALLY NOT THAT NECESSARY. Basically that one can just LISTEN TO THEIR HEART aka FAITH and by some virtuistic mysticism the truth will shine its lights onto ones lucky ass and everything will be all good. THIS TYPE OF PHILOSOPHY basically castrates ones SOURCE Of WILL and sets one off in a direction of continual dependence on some outside influence to validate ones own existence. In this STATE OF MIND if GOD does not recognize you then you aint shit. This completely disregards the fact that each one is GOD. That were at the same time the center and outermost part of eternity. There is nothing else expect for oneself therefor a muthafucker acting in this manner will surly be waiting around forever before they are able to realize their own life is happening right now, right here. Now this is the grimy part. The amount of time that one is controlled by another is the same amount of time that one allows themselves to be controlled by that certain other.
